Legislative Matter No. 980276. Petition 156TCH-98PB, City Plan Board. Amend the City of Gainesville Land Development Code to allow stormwater facilities developed by the City as a permitted use in all zoning districts and to require the undergrounding of all utilities for all new development.
Explanation
The purpose of this petition is twofold: to allow City-developed stormwater projects in all zoning districts and to require new development to underground all facilities including cable and telephone lines. It is staff's opinion that City-developed stormwater facilities are a utility, and they benefit the public in general instead of a single private property owner. Therefore, these facilities should be permitted just like electric, water and wastewater facilities.
During the past several months, the City Commission has been discussing with Gainesville Regional Utilities the issue of undergrounding all utilities. The result of those discussions was that the City initially should concentrate on undergrounding utilities for new development projects. Generally, all new subdivisions have underground utilities. This amendment will require all new development projects to have underground utilities. This amendment also will require private utilities to be placed underground at the same time as other utilities.
The Plan Board reviewed the petition and recommends approval.
Public notice was published in the Gainesville Sun on August 4, 1998. The Plan Board held a public hearing August 20, 1998.
