Title Street Vacation Criteria Explanation Approximately 18 months ago staff developed criteria for the vacation of public right-of-way at the direction of the City Commission. Staff researched other communities and developed a list of criteria, that was added to the application to vacate public right-of-way. Staff has used this criteria for several months to review applications for vacating a public street. However, it was brought to staff's attention that the City Commission had not approved the criteria. The criteria address whether the City needs the right-of-way for public benefit, the impact on public safety and welfare and whether individual private property rights would be violated. Fiscal Note None Recommendation Staff to the City Commission: approve the criteria for vacating public right-of-way and authorize staff to initiate a petition to amend the land development code to include the criteria.
