This item involves Mayor authorization to execute a Release of Easement onto Wal-Mart for an abandoned lateral ditch.
 
Explanation
In 1998, the City acquired a lateral ditch and its associated easement from the State of Florida Department of Transportation that is generally located in the 1200 block of Northeast Waldo Road and running northeasterly through that property owned by R. O. Camp by Quit-claim deed.  The City also received approximately $120,000 from the State, that was used to help fund the costs of relocating the ditch.  The ditch generally split the parcel and was relocated to create a more desirable parcel area and shape for commercial development.  R. O. Camp currently has a contract to sell this property to Wal-Mart for construction of a Super Wal-Mart.  Wal-Mart requests the release of the easement as it conflicts with their development plan.  The Public Works Department concurs with the request to release the easement.
 
Fiscal Note
Cost incurred will only be administrative costs associated with the preparation of the Release of Easement Agreement.
 
Recommendation
The City Commission:  1) approve the release of easement for the abandoned lateral ditch; and 2) authorize the Mayor to execute the Release of Easement onto Wal-Mart.
