Explanation
The City Commission's previous rate denial would have required Cox to rebate to customers certain items that were, in the opinion of City staff and the City's consultants, methodological areas of dispute included in Cox's rate base for the year ending May 31, 2004. In response to that denial, Cox has revised its current 2004 filings, which rates will take effect within 60 days. The revised rate filing takes into account a portion of the items that the City's consultant had identified in the rate denial report. The effect of this revised filing will be to reduce rates going forward a total of $1.05 per month for the basic tier rate (this reflects an additional $.25 per month per subscriber than that calculated in the initial filing). Rescission of the denial will moot the FCC petition process, thus saving staff time and consulting fees.
Fiscal Note
The City's estimated share of fees resulting from an FCC appeal was estimated at $6,000.
Recommendation
The City Commission adopt the Resolution rescinding the April 26, 2004 denial of Cox Com, Inc.'s 2003 rate filing.
