Land Acquisition Professional Services Contract with Alachua Conservation Trust (B)
This item involves the City contracting with Alachua Conservation Trust (ACT) to provide land acquisition services for the Wild Spaces Public Places Half Cent Sales Tax project.
Explanation
On February 19, 2009, the City's Department of Parks, Recreation and Cultural Affairs provided an update to the Gainesville City Commission regarding development of an Implementation Plan for the Wild Spaces Public Places (WSPP) One-Half Cent Sales Tax. This plan included the component of land acquisition services needed by the City for its priority listing of sensitive lands for WSPP.
The City of Gainesville proposes to contract with ACT to provide land acquisition services for the WSPP project. Services to be provided by ACT include: 1) negotiate with landowners on a list of potential projects to determine those landowners who are interested and motivated to sell their land in fee simple or less-than-fee; 2) order, receive, and review a title and encumbrance report and/or title insurance commitment certified to the City and to any partnering agency; 3) order, receive, and review a Phase 1 environmental audit certified to the City and to any partnering agency; 4) consult with the City to review the findings of the Phase 1 environmental audit and to determine the necessity of conducting a Phase 2 environmental audit; 5) order, receive, and review appraisals of the project property certified to the City and any partnering agency; 6) negotiate assignable option contracts; 7) negotiate any out-parcel sale(s) to third parties; 8) assign option contracts, less any out-parcels, to the City for no additional consideration; and 9) other related responsibilities as described in the proposed agreement.
Fiscal Note
The cost for these professional services is $75,000. This is an anticipated WSPP project expense; funding is available in the WSPP budget for this professional service....
