REQUEST FOR RESCISSION OF FINE AND RELEASE OF CODE ENFORCEMENT BOARD LIEN (B)

recommendation

The Gainesville Code Enforcement recommends that the City Commission (1) rescind the fine; (2) release the lien; and (3) authorize the Mayor and the Clerk of the Commission to execute the release of lien.

 

explanation

In October 1994, the owner was cited for failure to maintain their property in a manner free of trash, junk, and debris, and was taken to the Code Enforcement Board on April 13, 1995.  The respondent was found guilty and assessed a daily fine.  The fine and lien ran on this property until the property came into compliance.  The Respondent did not notify the City that compliance was achieved until just recently.

 

When the respondents contacted the City, the Code Enforcement Officer in the case issued an affidavit of compliance.  The Code Enforcement Board heard the case on June 8, 2000, and recommended to the City Commission that the lien in the amount of $93,000 be extinguished.
