An ordinance of the City of Gainesville, Florida, amending the Zoning Map Atlas and rezoning certain property annexed into the City from the Alachua County zoning category of "BH, business, highway" to the City of Gainesville zoning category of "MU-1: 8-30 units/acre mixed use low intensity; located in the vicinity of 3230 S.W. Archer Road; providing a severability clause; providing a repealing clause; and providing an immediate effective date.

STAFF REPORT
The City of Gainesville annexed an 8-acre parcel on SW 34th Street on May 8, 2000. As a part of the update of the Future Land Use Element of the Gainesville Comprehensive Plan, the City established a Mixed Use Low (MUL) land use designation, which was compatible with the County land use designation. The MUL designation allows the present residential operation at this property to remain conforming, as well as allowing existing retail and office operations at this location. MUL allows residential densities up to 30 units/acre. Regency Oaks, the name of the project located at this property, is approximately 18 units per acre.
Adjacent parcels are designated for retail zoning outside of city limits to the west, education (University of Florida) to the north and retail to the east (BUS) and south (BUS).
Because the character of nearby properties is compatible, and because it is an implementing zoning district for the MUL land use category, this property is most suitably zoned as MU-1.
The Plan Board heard the petition and recommended that it be approved.
