Title Partial Release of Public Utilities Easement to Sun Circle, Inc. Explanation Sun Circle, Inc. granted the City of Gainesville a public utilities easement in December of 1986 for the construction, operation and maintenance of underground electric lines and related appurtenances necessary to serve the Sun Center, located at 101 SE 2nd Place. Subsequent to the granting of the public utilities easement, the Sun Center was constructed. A survey prepared by J. W. Brown, Inc., Land Surveyor, dated April 30, 1998, indicates a portion of the Sun Center building was built over the southwest corner of said easement. Sun Center, Inc. is desirous of clearing this cloud on their title. The proposed Partial Release of Easement document releases the area of encroachment. Staff of Gainesville Regional Utilities has reviewed and approved this request. It has also been confirmed that no electric water, sewer or gas facilities exist within the area of proposed release. Recommendations The City Commission: 1) approve the partial release of public utilities easement; and 2) authorize the Mayor-Commissioner and Clerk of the Commission to execute a Partial Release of Easement instrument substantially in the form attached, subject to approval by the City Attorney.
