Explanation

AMJ Inc. of Gainesville, the developer of the Commerce Project, has proposed that the City convey to AMJ a license to an area to be used for construction staging equipment.  Staff proposes that the City convey to AMJ a license over the southwestern portion of the City lot east of the City parking lot (a portion of the property that in time will be Phase III of the Commerce Project).  The construction phasing license is an interim measure, because in time the City will convey Phase III to the CRA to convey to AMJ, but not until the beginning of construction of Phase III.  The license agreement contains provisions that all trees will be protected.

Fiscal Note

No charge will be made, as the advantage to the City is that the former NE First Avenue from 3rd Street to 4th Street now owned by AMJ will not be needed for staging and will stay physically open to the public longer.

Recommendation

The City Commission authorize the City Manager to execute a license for construction staging over a portion of Parcel 14714-1 to the Gainesville Commerce Center Limited Partnership.
