Partial Release of a Platted Public Utilities Easement on Lot 10 of Rosehill
Explanation
At the time Rosehill subdivision was developed in 1961, a 7 1/2' foot wide public utility easement was dedicated to the public forever on Lot 10. Recently, prior to the closing for the sale of this property, an encroachment of the pool and screen room into the public utility easement was revealed. A survey of the property prepared by Kris Ann Gath Land Surveying & Mapping confirmed said encroachment. The new owner is desirous of clearing this cloud on the title. The proposed Partial Release of Easement document releases the City's interest in the area of encroachment in the easement.
This request for partial release of the public utility easement has been reviewed by Gainesville Regional Utilities staff. It was confirmed that no electric, gas, sewer or water facilities exist within the area of the proposed release. It should be noted that the City of Gainesville is releasing only its interest and that other public utility entities will each have to release their interests separately. The owner has been advised of this fact.
Recommendations
The City Commission: 1) approve the partial release of a platted public utilities easement; and 2) authorize the Mayor and Clerk of the Commission to execute the Partial Release of Easement, subject to approval by the City Attorney.
