Resolution Requesting an Easement from the State of Florida (B)

Explanation

Staff is seeking an easement for the operation and maintenance of water utility facilities installed within the right-of-way of Hull Road Extension located to the north of the University Hotel and Conference Center, west of SW 34th Street. It is anticipated that this road right-of-way will be dedicated as a public State Road in the future, however, until that time the roadway is owned by the Trustees of the Internal Improvement Trust Fund of the State of Florida and leased to the University of Florida. 

 

The water utilities were installed at the request of the University of Florida to serve the newly developed Florida Student Parking Facility, also known as the "Park and Ride Lot" located west of the conference center.  These utilities will be operated and maintained by the City of Gainesville, therefore it is necessary to obtain an easement over the utilities until such time as the road is dedicated as a public state road. 

 

The attached resolution is a necessary prerequisite to requesting easements from the Trustees of the Internal Improvement Trust Fund of the State of Florida and allays concerns regarding the granting of the same.

Recommendations

The City Commission: 1) adopt a resolution, subject to approval by the City Attorney as to form and legality, requesting the State of Florida Department of Environmental Protection to obtain authority from the Trustees of the Internal Improvement Trust Fund to grant an easement to the City of Gainesville; and 2) authorize the General Manager or his designee to execute and accept the easement document on behalf of the City of Gainesville, subject to approval as to form and legality by the City Attorney.
