Explanation
Butler Apartments, Inc. granted the City of Gainesville an easement for various utilities in several separate locations in March of 1981. One of the easements prescribed was necessary for the operation and maintenance of electric lines in the 4200 blk. of SW 24th Avenue. Subsequent to that time the electric lines were abandoned and relocated to the western right-of-way of SW 42nd Street, which lies to the east of the subject property. The relocated facilities were placed within the public right-of-way of SW 42nd Street and did not require any easements.
Recently, the owner has requested that the City release the portion of the easement granted in 1981 to cover the electric lines in the original location. Staff has reviewed this request and confirmed that no electric, water, sewer or gas facilities exists within the area to be released. Therefore, staff has no objection to the partial release of easement.
Recommendations
The City Commission: 1) approve the partial release of a public utilities easement located in the 4300 blk. of SW 24th Avenue to S. Clark Butler; and 2) authorize the Mayor and Clerk of the Commission to execute the Partial Release of Easement, substantially in the form on file, subject to approval by the City Attorney.
