N.W. 7th Lane Mediation Agreement (B)
Explanation
In accordance with a request of the City Commission, on February 10, 1999 five property owners residing along NW 7th Lane attended a mediation session sponsored by the Community Mediation Services at the Alachua County Courthouse. Although the parties reached substantial agreement at the mediation session, they continued negotiations over the past year. The parties have now reached a settlement agreement executed by all parties. The settlement agreement is contingent on the City Commission agreeing to do the following work within the public right-of-way:
1. Repave NW 7th Lane;
2. Remove the westernmost existing "french drain";
3. Remove the asphalt turn around immediately west of the "french drain" and replace with pervious material (topsoil);
4. Designate the above noted area as neighborhood parking; and
5. Remove the existing brick pillars.
The Public Works Department included NW 7th Lane in the 1997 Resurfacing Plan approved by the City Commission. Implementation has been pending resolution of the dispute. The remaining work can be funded through the current operating budget of the Public Works Department.
Fiscal Note
Funds are available in the operating budget of the Public Works Department.
Recommendation
The City Commission: 1) accept the Settlement Agreement between the property owners on NW 7th Lane; and 2) authorize staff to implement the work within the public right-of-way.
