Northwest 19th Street Roadway Reconstruction Project (B)
Explanation
City staff has made numerous attempts to obtain the right-of-way needed from Dorothy Greene to complete the roadway reconstruction of Northwest 19th Street. Negotiations commenced May 12, 1999, with John Eddy, husband to Ms. Greene. Ms. Greene and Mr. Eddy have refused to negotiate and own the lone remaining parcel needed for the project. The City needs approximately .031 acres along the west side of the Greene property located at 1841 Northwest 39th Avenue, referred to as Parcel 95-37-02, a portion of the parent parcel number 8985-001. This property was appraised at $2,421.00, which the City offered Ms. Greene. She did not respond to this offer. City staff needs approval from the City Commission before initiating the Eminent Domain process. The Eminent Domain process requires that the appraised amount be placed with the Registry of the Court. At the hearing, the Judge will determine the amount to be paid to Ms. Greene. It can be the original amount or greater.

The funding needed for this process is available in the Northwest 19th Street Reconstruction Capital Project Account.
Recommendation
The City Commission: 1) approve the resolution authorizing condemnation of .031 acres of the property located at 1841 Northwest 39th Avenue, referred to as Parcel 95-37-02, a portion of the parent parcel number 8985-001; and 2) authorize the City Manager to execute any applications, agreements, or any other related documents and take any other actions necessary to complete the Eminent Domain process subject to approval of the City Attorney as to form and legality.
