COMMUNITY DEVELOPMENT STAFF REPORT

The Carol Estates South subdivision was built and platted in approximately 1963. That plat dedicated a ten-foot wide pedestrian pathway to the public. The pathway, which runs through a block, is located between Northeast 15th Terrace and Northeast 16th Terrace, at approximately 18th Avenue.

Several years ago, in response to concerns that people congregated along the pathway and disrupted adjacent residences, residents of the neighborhood began discussions with the City about vacating the pathway. Being reluctant to give up access to utility lines, the City decided to try another option on a trial basis. Therefore, in October 2002, the City installed fences on both ends of the pathway to close off pedestrian access to the pathway.

In June 2003, the neighborhood approached the City Commission and again requested that the City abandon the pathway. The residents cited continued problems with maintenance and crime. At that time, the City Commission referred the request to the Public Safety Committee, which held two public meetings on the issue. The Public Safety Committee recommended that the City Commission authorize staff to process a petition to abandon the pathway. On December 8, 2003, the City Commission accepted the Public Safety Committee's recommendation and authorized staff to process a petition to abandon the pathway.
