Boulder's Civil Nuisance Abatement Ordinance (NB)
Explanation
The Community Development Committee discussed at two meetings whether Gainesville should consider a civil nuisance abatement ordinance modeled on the Boulder Colorado Ordinance. The City Attorney and Community Development Committee staff reported that the Boulder Ordinance was consistent with state authorization in Colorado. However, in Florida, authorization for local nuisance abatement boards to be established and to issue fines is limited to jurisdiction over properties where particular criminal activities have occurred. Gainesville has recently established such a nuisance abatement board to address properties with such repeated criminal occurrences.
Also the City is in the process of adopting a landlord permit point system that would address situations where there are repeated violations of specific civil ordinances on rental properties. The Community Development Committee concluded there is no authorization by a civil board and the issues are being handled through other mechanisms.
