An ordinance of the City of Gainesville, Florida, amending s. 13-19 of the Code of Ordinances, by adding definitions for abandoned vehicle and vehicle; amending s. 26-140 of the Code of Ordinances, relating to the release of impounded vehicles to correct a scrivener's error; amending s. 13-171(c) of the Code of Ordinances, by requiring the removal of dead or hazardous trees, limbs and debris from residential property; providing directions to the codifier; providing a severability clause; providing a repealing clause; and providing an immediate effective date.
 
recommendation
The City Commission adopt the proposed ordinance, as amended.
 
explanation
At its meeting of September 9, 2002, the City Commission authorized the City Attorney to draft and the Clerk of the Commission to advertise an ordinance amending the minimum housing code.  Currently, Section 13-171(c) requires all residential properties to be kept clean and for owners to remove dead trees, trash and garbage.  At first reading, the City Commission directed staff to consider the comments made at the meeting, and to amend the ordinance to address those comments.  The amendment clarifies that all trash and debris and dead or hazardous trees and dead tree limbs and vegetative debris that pose a hazard to neighboring properties, must be removed from residential property.  In addition, for purposes of clarification, definitions for Vehicle and Abandoned Vehicle are proposed to be added to the housing code.  A scrivener's error in Chapter 26 of the Code, related to release of impounded vehicles, is corrected.
