Explanation
Mr. Howard Wallace, developer of Mill Pond subdivision, has requested the City of Gainesville to release any interest they may have in a Non-Exclusive Water and Sewer Line Easement granted on October 30, 1990, to Signature Properties, Inc., d/b/a Mill Pond and Alachua County, as recorded in Official Record Book, 1790, page 2736 of the public records of Alachua County. Staff has determined that any interests or rights the City may have in the referenced easement are not necessary for GRU's operation and maintenance of existing water or sewer facilities, as GRU's facilities are covered by other easements granted to the City of Gainesville.
Recommendations
The City Commission: 1) approve the release of a non-exclusive water and sewer line easement; and 2) authorize the Mayor and Clerk of the Commission to execute the Release of Easement, substantially in the form on file, subject to approval by the City Attorney.
