The City Commission authorize the Mayor and Clerk of the Commission to execute the amendments to the Employment Agreements of the City Auditor and City Attorney.
explanation
Since the notice of voluntary resignation of the City Auditor, the City Attorney and City Auditor became aware that their employment agreements could be interpreted to provide that a severance payment be paid to the City Auditor under these circumstances. In order to eliminate this possible interpretation, we have prepared amendments to the agreements that make it clear that no severance payments are due under the circumstances of a voluntary resignation. The City Manager's and Equal Opportunity Director's employment agreements do not provide for severance payment in the event of a voluntary resignation.
The City Auditor's amendment will be effective retroactive to July 1, 2004, so that it is effective prior to his departure date.
