Usage Certificates (B)  

This item is a request for approval and authorization to execute Usage Certificates.

Explanation

In the 1950's and 1960's, the Florida Department of Transportation installed drainage facilities in the approximate area of the 500 block of Northeast 19^th and 20^th Street and east of Northeast 25^th Street and Northeast 2^nd Place.  These drainage facilities have been maintained by the City since their installation.  In preparation of the survey associated with the Northeast 19^th Street, Northeast 19^th Terrace, Northeast 19^th Drive and Northeast 25^th Street renovations, commonly referred to as the Northeast Safetea-Lu Project, it was discovered that title to portions of the drainage facilities  have not been conveyed onto the State or City.  These portions of the drainage facilities lie in property outside of the two adjacent platted properties and are deemed to be hiatus.  In accordance with the provisions of Section 95.361 (1), Florida Statutes, 2008, the subject usage certificate depicts and describes the appurtenances in and to the City roads, specifically the portions of the drainage facilities, which the City has maintained and kept in repair uninterruptedly for a period of four years or more.

Fiscal Note

Funding in the amount of $30 for administrative costs and for the document recording fees is available in the Public Works FY09 operating budget.

Recommendation

Recommended Motion:  The City Commission:  1) approve and authorize the Mayor to execute, and the Clerk to attest the Usage Certificates, subject to approval by the City Attorney as to form and legality; and 2) authorize the City Manager or designee to record the Usage Certificates in the Public Records of Alachua County, Florida.
