Release of Easement at Pinehurst Mobile Home Park (B)
Explanation
In the 1960's when Pinehurst Mobile Home Park, located in the 3500 blk. of SW 24th Avenue, was developed, several easements were granted to the City of Gainesville. These easements were granted to facilitate the City's operation and maintenance of drainage, potable water, sanitary sewer, and electric utility facilities as well as a sanitary sewer lift station. The easements were granted by way of dedication in Articles of Agreement between the previous property owner and the City of Gainesville, as well as actual written grants of easement.
The park site has recently been purchased and the new owners are in the process of developing The Exchange at Gainesville Apartments on the site. In order to accommodate the new development all existing utilities are being abandoned and/or removed and new utilities are being installed. Therefore, the owners have requested that all existing easements granted to the City be released in exchange for a blanket utilities easement covering the entire site and a deeded lift station site.
Staff has reviewed this request and agreed to accept a blanket easement and a deeded lift station site in exchange for releasing all existing easements. A fully executed blanket easement and lift station site deed have already been received. The proposed release of easement releases the City's interest in all previously granted and/or dedicated easements to the City of Gainesville.
Recommendations
The City Commission: 1) approve releasing several easements granted to the City of Gainesville at Pinehurst Mobile Home Park; and 2) authorize the Mayor and Clerk of the Commission to execute a Release of Easements document, substantially in the form attached, subject to approval by the City Attorney.
