Amendment No. 2 to Lease Agreement with Alachua County (B)
Explanation
April 23, 2001, the City Commission approved a Lease Agreement between the City and Alachua County for the construction, operation and maintenance of a ten foot wide paved bikeway/pedestrian path within the City's utility corridor located along the south side of SW Archer Road from SW 75th Street west to SW 88th Street. In 2004 the City approved an Amendment to the Lease Agreement to extend the path west from SW 88th Street to SW 91st Street.
In conjunction with the upcoming Southwest YMCA development to be constructed at 9315 SW Archer Road, the County has requested that the Lease Agreement be amended a second time to allow for the extension of the path from SW 91st Street west to the western property line of YMCA's property, approximately 920'. Staff has reviewed this request and has no objection to the Amendment.
In accordance with the original Lease Agreement, the attached Amendment allows for the expansion of the paved bikeway/pedestrian pathway, while maintaining all of the original terms and conditions of the original Agreement.
Recommendations
The City Commission: 1) approve Amendment No. 2 to a Lease Agreement between the City of Gainesville and Alachua County for the construction and maintenance of a paved bikeway/pedestrian path within the City of Gainesville's/GRU's utility corridor located along SR 24 - SW Archer Road; and 2) authorize the General Manager, or his designee, to execute the Amendment, subject to approval as to form and legality by the City Attorney.
Fiscal Note
There will be no cost to the City of the construction and subsequent maintenance of the paved bikeway/pedestrian path.
