COMMUNITY DEVELOPMENT DEPARTMENT STAFF REPORT

This petition provides an opportunity to remove an unneeded section of the City's Land Development Code.

Contemporary building construction and fire protection codes that have been adopted and are now used by the City of Gainesville-specifically, National Fire Protection Association code 30 and 30A-are sufficient to adequately and safely address concerns that were previously addressed by Sec. 30-344 ("Storage of Flammable Liquids") in the Land Development Code. In other words, Sec. 30-344 is now out-of-date.

Note that the provisions now found in 30-344 originally appeared in the City fire protection code in 1949 (dealing strictly with gasoline storage), and had meaningful amendments in 1958 and 1962.

According to an electronic mail dated May 24, 2004 from Gainesville Fire-Rescue Chief Richard F. Williams, NFPA 30A has "standards for property build-line distance for fuel dispensing sites," and requires no setback at all "for fuel tanks that are located below ground [such as at a gas station] or in a code-compliant above-ground vault." He goes on to state in this letter that "any fuel-dispensing station built in the city will continue to require compliance with this provision." He therefore believes that the flammable liquids hazard is adequately addressed by NFPA 30A and that the City "can remove the 250-foot distance in our Land Develop...
