Release of Easement to Woodland Partners, Inc.
Explanation
A perpetual tree trimming easement was granted to the City of Gainesville on Lots 8 and 9 of Glenwood Estates located at the corner of SW 8th Avenue and SW 75th Street in September of 1993. The rights granted included the specific right to remove trees in order to maintain adequate clearance between our overhead electric distribution lines and vegetation located along SW 8th Avenue and SW 75th Street.
Recently, the owners have decided to re-plat this area as The Woodlands, Units 5 & 6. The Alachua County Planning Department is requiring the owners to designate a ten-foot wide strip of property running along SW 75th Street and SW 8th Avenue as an undisturbed buffer. The 1993 easement allowing for the removal of trees is located in a portion of the area to be designated as an undisturbed buffer.
To avoid conflicts in the future, the owners have proposed granting a new easement to the City allowing tree trimming only but extending along the entire piece of property to be re-platted adjacent to SW 8th Avenue and SW 75th Street. In exchange for the new easement, the owners have requested that the City release the easement granted in 1993.
Upon recordation of both the new easement and the proposed release of easement documents, the new plat of the area will be recorded indicating a natural buffer subject to the new tree trimming easement.
This request has been reviewed and approved by GRU staff. It has also been confirmed that no electric facilities exist within the actual area to be released.
Recommendations
The City Commission: 1) approve the release of an easement to Woodland Partners, Inc., located on Lots 8 and 9 of Glenwood Estates in the 800 blk. of SW 75th Street; and 2) authorize the Mayor and Clerk of the Commission to execute the Release of Easement document, subject to approval by the City Attorney.
