Blues Creek Partial Release of Easement (B)
Explanation
In 1986, the owner of property being developed as the Blues Creek subdivision, Blue's Creek Development Limited, granted the City a thirty-foot wide public utility easement located along the entire west side of the development. The owner has now requested the release of a portion of the easement located in the newest proposed phase of the subdivision, Blue's Creek, Unit 5, Phase 1, which is located along the northwest side of the subdivision.
The easement that was acquired in 1986 was proposed to provide an electric back feed to the Blues Creek development. A portion of the existing easement is being utilized for this purpose along the southwestern portion of the development. However, the entire easement has not been utilized and the development plans for the subdivision have changed significantly since 1986. Staff has reviewed the newest master plan for the development and it has been determined that it will be acceptable to release a portion of easement as requested. As future phases of Blues Creek develop, the use of the remaining portion of the easement for utilities will be determined.
Recommendations
The City Commission: 1) approve the partial release of a public utility easement; and 2) authorize the Mayor and Clerk of the Commission to execute the Partial Release of Easement, substantially in the form on file, subject to the approval by the City Attorney.
