Explanation
On July 28, 1997, the City passed and adopted an ordinance to vacate, abandon and close a portion of NW 18th Street south of NW 31st Place, reserving an easement over a portion of the right-of-way for utilities. The property owner that acquired a portion of the vacated right-of-way, Country Manor Apartments, Ltd., is now developing their property and require a partial release of the easement to accommodate the construction of apartment buildings.
This request for a partial release of the public utility easement has been reviewed and approved by staff. It was confirmed that no water, sewer or gas facilities exist within the area of the proposed release. Existing overhead electric facilities were removed and converted to underground utilities in a new location within the easement and outside the area of the requested release.
It should be noted that the City of Gainesville is releasing only its interest and that other public utility entities will each have to release their interests separately. The owner has been advised of this fact.
Recommendations
The City Commission: 1) approve the partial release of a public utilities easement; and 2) authorize the Mayor and Clerk of the Commission to execute the Partial Release of Easement, substantially in the form on file, subject to approval by the City Attorney.
