Blocked Pathway at 1700 Block of NE 15th & 16th Terrace (B)
Explanation
The Public Safety Committee held two public meetings on this request by residents in the Carol Estates neighborhood. Residents are seeking approval for the City to abandon the 10' walkway right-of-way between NE 15th and 16th Terraces in the 1800 block. On the south side of the crosswalk is a 5' platted public utilities easement where an 8' sanitary sewer line is installed and on the north side is a 15' platted drainage easement where an 18" concrete storm sewer line is installed. When the residents initially approached the City to abandon the property, a temporary fence was installed by the City on both the east and west ends in October 2002 to determine if the blocked pathway would alleviate the residents' concerns with criminal activity.
The neighborhood approached the City Commission in June 2003 and again requested consideration by the city to abandon this walkway right-of-way to the residents.
Recommendation
The City Commission approve the Public Safety Committee's recommendation to 1) authorize the City Manager to file a petition to vacate public right-of-way, 2) the City waive the application fee of $687.75, 3) if the petition to vacate the public right-of-way is approved, the City retain a public utilities and ingress/egress easement across the 10', 4) the City absorb the cost for labor and equipment ($4,305.53) to remove the sidewalk, 5) require the residents to absorb the material costs to include loader rental ($320.30), concrete dump fees ($150.00), fill dirt and sod replacement, and 6) remove this item from the Public Safety Committee referral list.
