Explanation
On April 7, 1999, the City and AMJ, Inc. entered into a License Agreement that set out the terms under which the City would make available to the Commerce Project 56 parking spaces located at the northeast corner of City Hall property for vehicular parking from 7:00 A.M. to 6:00 P.M. Monday through Friday of each week, except national holidays, for 25 years.
 
On April 3, 2001, the License Agreement was amended recognizing Gainesville Commerce Center Limited Partnership as the successor to AMJ, Inc. and changing the starting date for the term of the License Agreement to "the later of: 1) the issuance of the first Certificate of Occupancy for the Commerce Building, or 2) the completion by Licensee and acceptance by the City of the Streetscape pursuant to the Agreement dated March 27, 2001."  Although the events establishing the revised starting date occurred in 2002, the Licensee did not begin using any of the designated parking until April 13, 2004.  On that date, the Licensee started using 26 of the spaces.  Use of the remaining 30 spaces has been postponed until a later date.
 
On March 31, 2004, the Gainesville Commerce Center Limited Partnership requested that the City provide a second amendment to the parking license agreement that provides a June 1, 2004 start date for the 25-year agreement.

Recommendation
