Deed from City to the University Athletic Association, Inc. (B)
Explanation
In 1951 the City acquired a 105' x 105' lift station site at the University of Florida Golf Course. Subsequently Lift Station Number One was constructed at the site.
Recently, The University Athletic Association (UAA) constructed a maintenance facility at the Golf Course. A final survey of the site prepared by McMillan Surveying, Inc., reveals several encroachments along the western property line of the City's Lift Station Site. These encroachments will limit the City's ability to expand or enhance the Lift Station in the future should it be needed. In order to eliminate these encroachments staff has successfully negotiated with UAA to exchange the west seven feet of the lift station site for an additional 7.6' along the east boundary line of the site.
UAA has executed and delivered a Warranty Deed transferring title to 7.6' located immediately east of the City's Lift Station Site on UAA land to the City of Gainesville. As negotiated the attached deed will transfer ownership of the west 7' of the Lift Station Site to UAA. This land swap will eliminate all encroachments and provide for the City's ability to expand the site in the future if needed.
Recommendations
The City Commission: 1) approve the granting of a Quit-Claim Deed to The University Athletic Association, Inc.; and 2) authorize the Mayor and Clerk of the Commission to execute the Quit-Claim Deed, subject to approval as to form and legality by the City Attorney.
