Greenbriar Subdivision Stormwater System (B)
Explanation
Many years ago, the Greenbriar Subdivision, generally located on the west side of NW 34th Street in the 2000 block, was developed with the stormwater system discharging on the property to the south. From there the stormwater runoff flowed to a depression basin. Since that time, the property receiving the Greenbriar Subdivision stormwater has been sold and approval has been granted for the Greenbriar Terrace development on the subject property.
The current owners/developers, Samuel W. Floyd and Ernestine J. Floyd, and the Public Works Department have negotiated a contingent agreement where the Floyds would grant to the City an ingress/egress and a drainage easement sufficient to provide the City access to the proposed stormwater system that will connect the current outfall point of the Greenbriar Subdivision stormwater system to the Greenbriar Terrace stormwater retention system. The drainage easement includes the perpetual right of the City to discharge the existing stormwater flow from the Greenbriar Subdivision stormwater system into the Greenbriar retention system with no future obligations from the City. For the discharge rights in the drainage easement, the City will compensate the Floyds in the sum total of $60,207.
The contingent agreement also includes provisions for the City to compensate the Floyds in the total amount of $10,320 for the construction of the storm sewer connection between the Greenbriar Subdivision stormwater outfall facility, the cost to "up-size" that portion of the Greenbriar Terrace stormwater system that conveys the Greenbriar Subdivision stormwater to the Greenbriar Terrace retention system, and the cost to install a City- provided trash and sediment collection facility between the Greenbriar Subdivision outfall facility and the Greenbriar Terrace stormwater system.
