In May 2005, Watson filed a multi-count complaint against the City alleging that the City's enactment of a moratorium violated its constitutional rights. The City vigorously defended the case and filed for summary judgment on all claims. On May 23, 2006, Federal Judge Stephan P. Mickle entered an order granting summary judgment in favor of the City on all Counts. The City has filed motions to recover its costs and fees. The Court has not yet ruled on those motions. Plaintiff Watson Construction Co. filed an appeal in the 11th Circuit U.S. Court of Appeals. The City will file a brief and present oral argument to the Eleventh Circuit if oral argument is granted.
