Resolution Requesting an Easement from the State of Florida (B)
Explanation
The North Florida Evaluation and Treatment Center at Tacachale has experienced problems with the existing sanitary sewer and lift station facilities located in an existing easement. Gainesville Regional Utilities (GRU) has been working to correct these problems by providing temporary modifications to the existing lift station. However, it has been determined that the existing lift station will need to be replaced. In order the keep the existing lift station in service at all times, the new lift station will be built in a location adjacent to and outside the existing easement. Therefore, it will be necessary to obtain a new easement to allow GRU to construct, operate and maintain the new sanitary sewer and lift station facilities.

The utility facilities will be located on property owned by the Trustees of the Internal Improvement Trust Fund of the State of Florida and leased to North Florida Evaluation and Treatment Center and the Florida Department of Children and Families. Accordingly, it is necessary to obtain an easement over these utility facilities from the State of Florida. The attached resolution is a required prerequisite to requesting easements from the Trustees of the Internal Improvement Trust Fund of the State of Florida and allays concerns regarding the granting of the same.
Recommendations
The City Commission: 1) adopt a resolution, subject to approval by the City Attorney as to form and legality, requesting the State of Florida Department of Environmental Protection obtain authority from the Trustees of the Internal Improvement Trust Fund to grant an easement to the City of Gainesville; and 2) authorize the General Manager or his designee to execute and accept the easement document on behalf of the City of Gainesville, subject to approval as to form and legality by the City Attorney.
