Partial Release of Easement at Springhill Commons Shopping Center, 9100 blk. of NW 39th Avenue (B)
Explanation
Island Point, Inc. granted the City of Gainesville a metes and bounds easement in January, 2000 for the construction, operation and maintenance of electric, water, sewer and gas utility facilities at the Springhill Commons Shopping Center, located in the 9100 block of NW 39th Avenue. Subsequent to the construction of the shopping center a boundary survey of the property was prepared by McMillen Surveying Inc. This survey reflects that a portion of a building was constructed in the easement area. The owner is desirous of clearing the cloud from his title and has requested that the area of encroachment be released.
GRU staff has reviewed the matter of the encroachment and verified that there are no existing electric, water, sewer, gas or GRUCom utility facilities located in the area of encroachment, and therefore has no objection to the City releasing its interests in the encroached area of the easement.
Recommendations
The City Commission: 1) approve the partial release of a public utilities easement to Island Point, Inc.; and 2) authorize the Mayor and Clerk of the Commission to execute the Partial Release of Easement, subject to approval by the City Attorney as to form and legality.
