recommendation
The City Commission authorize the Mayor to execute, and Clerk of the Commission to attest, the Final Order.

explanation
On June 1, 2004, the City Commission, at the continuation of its regular meeting of May 24, 2004, held a de novo, quasi-judicial appeal pursuant to section. 30-112(d)(7)i., Gainesville Code of Ordinances.  The appeal was heard at the request of the Appellant, Giovanna Holbrook, for the purpose of considering the April 6, 2004 denial by the Historic Preservation Board of a Certificate of Appropriateness for the construction and modification of a masonry wall located at 207 NE 7th Street.  At its June 1, 2004 meeting, the Commission considered the record, evidence, and testimony of staff, interested persons, and the Appellant's attorney, Lloyd Vipperman, and announced its oral order in the matter of Giovanna Holbrook, Appellant (Legislative Matter 031242).

At the conclusion of the June 1, 2004 appeal, the City Commission voted to affirm the finding of the Historic Preservation Board and to deny the request of Appellant.  The Code of Ordinances requires the City Commission decision to be embodied in a written order.
