An ordinance of the City of Gainesville, Florida, amending Ordinance No. 070447 (as was subsequently amended by Ordinance No. 100189) related to Plum Creek Planned Use District (PUD); by providing an extension of time to adopt a Planned Development (PD) zoning ordinance; by deleting redundant Section 4 of both Ordinance No. 070447 and Ordinance No. 100189; providing a severability clause; providing a repealing clause; and providing an immediate effective date.

explanation
This Ordinance extends the timeframe for which a Planned Development (PD) zoning ordinance must be adopted to implement the Plum Creek Planned Use Development (PUD) land use overlay.
The PUD land use overlay as adopted on January 27, 2009 in Ordinance No. 070447 was subsequently amended by the adoption of Ordinance No. 100189 on October 21, 2010. One of the amendments included a time extension for the adoption of the PD zoning ordinance until July 26, 2012.
On January 16, 2012, the Plum Creek Timber Company, Inc. ("Applicant") requested a time extension for the deadline to adopt a PD zoning ordinance to implement the PUD land use overlay by an additional 48 months to July 26, 2016. On March 1, 2012, the City Commission considered the Applicant's request and authorized the City Attorney to draft an ordinance for consideration by the City Commission.

This Ordinance requires two hearings. Should this Ordinance pass on first reading, second and final reading will be held on May 3, 2012.
