Explanation
On April 19, 2012, the City was served with a Summons and Complaint filed by Gainesville Citizens Care, Inc. in the Circuit Court. Gainesville Citizens Care, Inc. alleges that the negotiations by City Staff and approval by the City Commission of the Gainesville Renewable Energy Center LLC (GREC) Power Purchase Agreement were conducted in violation of the Sunshine Law. Gainesville Citizens Care seeks an order declaring the Power Purchase Agreement void ab initio and enjoining the City from expending funds to implement the Power Purchase Agreement.

The City Commission authorize the City Attorney, assisted by Special Counsel, to represent the City of Gainesville in the case styled Gainesville Citizens Care, Inc. vs. City of Gainesville d/b/a Gainesville Regional Utilities; Eighth Judicial Circuit, Case No. 2012-CA-1346.
