This is a request for the City Commission to authorize the bid award in the amount of $5,191,900 to R.E. Arnold Construction, Inc., for the Depot Park Phase II Pond and Pump Station project.
 
Explanation
On July 25th, the City Purchasing Division solicited bids for the Depot Park Phase II Pond and Pump Station project.  Four (4) firms responded with bids.  R.E. Arnold Construction, Inc. was the lowest responsible and responsive bidder in the amount of $4,514,696.99.   The scope of this contract includes the Pump Station located east of SE 4 Street along Sweetwater Branch, the dewatering and construction of the pond and associated walls, lining and piping, the two foot clean soil cap over the site, and wetlands mitigation planting.
 
R.E. Arnold Construction, Inc. is also the lowest and responsive bidder for the NW 22 Street project that was subsequently bid.  Staff held a meeting with R.E. Arnold Construction to determine whether they had the capacity to deliver services on both projects simultaneously.  R.E. Arnold representatives presented a plan to staff that adequately demonstrated their intended approach to delivering both projects.
 
The Depot Park project has been a collaborative project between GRU, Public Works and CRA for a number of years.  GRU's primary responsibility has been associated with the coal tar and related remediation efforts; Public Works has been responsible for the development of the stormwater management aspects and agreed to manage the arsenic remediation for the site.  CRA has been responsible for the park components as well as the Depot Historic Building renovation work and coordination with the Cade Museum.  Through all phases of this transformational project the three entities have worked closely to ensure that all aspects were being coordinated and issues identified and addressed as efficiently as possible.  Due to the complexity of the project there has had to be a significant amount of flexibility and coordination of efforts especially in areas of overlap.  As we move forward with the construction of the pond and pump station components as well as the two foot cap for the arsenic remediation it will be important that all parties remain flexible and in close communication as CRA moves towards final design of the park components and the Cade Museum.  We will have regular meetings with CRA, Public Works and the Contractor to ensure close coordination of efforts.
 
Fiscal Note
Funding in the amount of $4,514,696.99 plus a 15% contingency amount for a total of $5,191,900 is provided by grants from the Department of Environmental Protection (DEP LP), Environmental Protection Agency (EPA SPAP) and the U.S. Department of Housing and Urban Development (HUD). Other funding includes monies from the Stormwater Management Utility Fund (SMUF) and a loan from the State Revolving Fund (SRF).
      
Recommendation
The City Commission:  1) hear a presentation from staff; and 2) award the bid to R.E. Arnold Construction, Inc., for the construction of the Depot Park Phase II Pond and Pump Station project; 3) authorize the City Manager to execute the contract, subject to approval as to form and legality by the City Attorney; and 4) issue a purchase order in an amount not to exceed $5,191,900.
