A Resolution of the City of Gainesville, Florida; approving the vacation of a portion of the Plat of "Shady Forest" recorded in Book 95, Page 255, of the Public Records of Alachua County, Florida, said portion being located north of SW 17th Place, east of the westerly boundary of SW 38th Terrace and west of the easterly boundary of SW 37th Street; providing directions to the Clerk of the Commission; providing for filing of the original hereof; and providing an immediate effective date.

The above-referenced Resolution is related to Petition No. CC-13-04 SUB, also on this agenda. This Resolution to vacate a portion of a plat of Shady Forest has been prepared at the request of the petitioner, pursuant to State law.
Section 177.101, Florida Statutes appears to require that plats be vacated by resolution of the governing body of the county where the property is situated. However, if the plat is located within a City, the statutes require the City Commission to adopt a resolution vacating the plat and to forward a certified copy of the resolution to the Board of County Commissioners.
