The city commission has approved an ordinance authorizing quasi-judicial hearings to be conducted by a special magistrate or the code enforcement board. The ordinance provides that the special magistrate and the code enforcement board shall not have simultaneous jurisdiction and the commission shall select, by resolution, which entity conducts the hearings.
Staff is in the process of issuing a Request for Proposals (RFP) for Code Enforcement Special Magistrate with an expectation that a Special Magistrate and a reserve Special Magistrate will be selected and implemented by October 1, 2013. Until such time as the Special Magistrate is prepared to assume the referenced duties and the commission authorizes same by Resolution, it is necessary that the authority to conduct quasi-judicial hearings remain with the code enforcement board.
