On February 2, 2016, Aspen American Insurance Company caused a Summons and Complaint to be served on the City's General Manager for Utilities in the above-referenced case. Of course, Gainesville Regional Utilities is not a proper party to the lawsuit and the General Manager is not authorized to receive service of process on behalf of the City, but it is anticipated that the Plaintiff will have an opportunity to correct these deficiencies. As to the substance of the Complaint, the Plaintiff alleges that it paid $202,910.00 to its insured as a result of damage sustained to the insured bowling alley's electrical system caused by lightning strikes. Plaintiff claims that the utility pole installed by Gainesville Regional Utilities was missing a ground connection resulting in the damage to the electrical system. Plaintiff is seeking money damages, interest and court costs.
