Easement for Duke Energy (B)

 

This item is a request to approve an easement for Duke Energy located on City owned parcels 06539-001-000, 06515-000-000, and 06715-002-001. These parcels are located in the Southwest part of the City and the easement extends from  approximately the 1400 block of SW 34th Street and runs west toward SW 52nd Street.

 

Explanation

There currently exists an easement over City conservation property, which was granted to Florida Power Corporation by order of taking recorded in OR Book 106, Page 48, final judgement recorded in OR Book 139, Page 49, and easement recorded in OR Book 78, Page 252. These documents date back to 1959 through 1961 and grant certain rights to Duke Energy of Florida, LLC who has merged with Florida Power Corporation and Progress Energy over the years and is now doing business as Duke Energy. Duke Energy wishes to upgrade its easement rights to include the original rights to cut and clear trees, clarify operating and maintenance rights of the transmission line, and build an at-grade pole pad and access improvements. Duke Energy will rebuild the existing transmission line that crosses the City owned parcels in order to meet reliability standards and strengthen the grid in the Gainesville area. All of the proposed improvements (including removing and relocating some poles) fall within the original 100 foot easement.

 

This easement request has been coordinated with Gainesville Regional Utilities and the Parks, Recreation and Cultural Affairs department and they have approved the language in the new easement. The Survey Division has verified the legals attached to the easement. The form of the easement has also been approved by the City Attorney.

 

Fiscal Note

There is no cost to the City. All work will be at Duke Energy’s expense and remain within the existing easement area.

 

Recommendation

The City Commission authorize the Mayor to execute the Supplemental Easement.
