title
JIM KONISH, DULY QUALIFIED CANDIDATE V. ADRIAN HAYES-SANTOS, CITY OF GAINESVILLE ELECTION CANVASSING BOARD & PAM CARPENTER, SUPERVISOR OF ELECTIONS; EIGHTH JUDICIAL CIRCUIT, CASE NO. 2016-CA-811 (B)
recommendation
The City Commission authorize the City Attorney to represent the City in the case styled Jim Konish, Duly Qualified Candidate v. Adrian Hayes-Santos, City of Gainesville Election Canvassing Board & Pam Carpenter, Supervisor of Elections; Eighth Judicial Circuit, Case No. 2016-CA-811.
explanation
On March 24, 2016, the City was served with a Summons for a Petition filed by Jim Konish on March 7, 2016 in the Circuit Court against the "City of Gainesville Election Canvassing Board" as well as the other listed parties. Mr. Konish alleges that Adrian Hayes-Santos did not reside in District IV six months prior to the date of qualifying as a candidate for City Commissioner. Mr. Konish requests the Court issue a temporary injunction preventing the certification of Mr. Hayes-Santos as a candidate for City Commissioner. As the March 15, 2016 election was canvassed by the Alachua County Board of Canvassers because of the Presidential Preference Primary, the City of Gainesville did not appoint a canvassing board this year. Accordingly, the City will move to dismiss the action against the "City of Gainesville Election Canvassing Board".
