Evaluation of the Need for an Ordinance Governing “Short-Term” Rentals

Explanation

The growing number of short-term rentals in the City has prompted several inquiries as to the City of Gainesville's position on governing these types of rentals beyond the existing regulations and separate from the existing Landlord Permitting regulations. Short term rentals are governed by ordinance in several cities throughout the state.

 

State Statute 509.032 (7) Preemption authority (b) a local law, ordinance, or regulation may not prohibit vacation rentals or regulate the duration or frequency of rental of vacation rentals. This paragraph does not apply to any local law, ordinance, or regulation adopted on or before June 1, 2011.

 

Fiscal note

There is no fiscal impact in this change. Only clarification.

 

Recommendation

The General Policy Committee 1) discuss and 2) provide recommendation as to the need for further regulatory code.
