An ordinance of the City of Gainesville, Florida; amending Sections 15-2, 15-3, 15-5, 15-6, 15-7 and 2-339 of the Code of Ordinances relating to Noise; providing directions to the codifier; providing a severability clause; providing a repealing clause; and providing an immediate effective date.

The City Commission adopt the proposed ordinance.
explanation
The City Commission at its meeting of July 21, 2022 (Legistar Item No. 211426), directed the City Attorney's Office to draft the proposed ordinance adding in prohibitions on the level of car stereo noise consistent with Fla. Stat. 316.3045.
While making these amendments, the City Attorney's Office found provisions prohibiting noise which "disturbs a reasonable person of normal sensitivities", which has been found unconstitutionally vague by local courts here in Gainesville, and other courts in the State of Florida. This language and its provisions has been removed from the ordinance.
