PLANNING AND DEVELOPMENT SERVICES DEPARTMENT STAFF REPORT
This ordinance vacates an unimproved alley public right-of-way that extends for 207 feet between SW 7th Terrace and SW 6th Street, south of SW 4th Avenue, as more specifically described and shown in the ordinance. The subject alley was originally part of a larger public right-of-way that was dedicated to the public by a plat; however, the City in 1972 vacated all of that public right-of-way except the portion that is the subject of this ordinance. The public right-of-way to be vacated is 22 feet wide and approximately 207 feet in length, and is not improved or used for public access. Currently, large trees and site improvements (parking areas) exist within or closely adjacent to the subject alley. Vacation of this public right-of-way will allow for the future redevelopment of a unified city block, which may not occur as proposed without the vacation. Authorization from the abutting property owners is included with the application.
Staff recommends approval of this vacation of public right-of-way, based on criteria for the vacation of public streets or public places found in Section 30-192 of the Land Development Code, and on the enumerated criteria found in Policy 10.2.1 of the Transportation Mobility Element.
